260042 Rechtfertigung der Strafe II (S) (SoSe 2022)

Contents, comment

Nachdem sich der Kurs im Wintersemester an klassischen Theorien der Strafe orientiert hat, sollen weitere Rechtfertigungstheorien der Strafe (Resozialisierung; Transitionelle Gerechtigkeit; Kompensationstheorie) und systematische Fragen (Determinismus, Verantwortung und Strafe; KI und Strafe) diskutiert werden.
Das Seminar kann auch von Personen besucht werden, die nicht am ersten Teil im Wintersemester teilgenommen haben. In den zwei ersten Sitzungen des Seminars wird ein Überblick über die im WS diskutierten Positionen angeboten. Er soll denjenigen, die neu einsteigen, die Möglichkeit verschaffen, sich mit den grundsätzlichen Begründungsmodellen der Strafe vertraut zu machen, die im Hintergrund der neueren Diskussionen stehen. Denjenigen, die das Seminar im Wintersemester besucht haben, steht es frei, ob sie diese Sitzungen besuchen. Eine Auffrischung der Kenntnisse ist jedoch allemal willkommen.
