Im Sommersemester 2019 biete ich ein Seminar zum Kartellrecht an. Es können u.a. folgende Themen bearbeitet werden:
1. Verhaltenskoordinierung durch Preissetzungsalgorithmen – ein Fall für das Kartellverbot oder bewusstes Parallelverhalten?
2. Unser Preis (nur) für Sie und jetzt gerade – gibt es kartellrechtliche Grenzen für die personalisierte und dynamische Preissetzung?
3. Vertriebsbeschränkungen im Internet: Verbot der Nutzung von Internetmarktplätzen (Plattformverbote) (EuGH, Rs. C-230/16 – Coty)
4. Vertriebsbeschränkungen im Internet: Verbot der Nutzung von Preissuchmaschinen (BGH, KVZ 41/17, „Asics“)
5. Neue Geschäftsmodelle und das Kartellrecht –Urteil des US District Court of the Southern District of New York in „Uber“, Case 15 Civ. 9796, Meyer/Kalanick [2016] (
6. Das Urteil des englischen High Court in „Streetmap vs Google“ – [2016] EWHC 253 (Ch)
7. Lizensierung von standardessentiellen Patenten (Urteil des EuGH, Rs. C-170/13 – Huawei Technologies)
8. Private Kartellrechtsdurchsetzung: Preisschirmeffekte und Haftungsrecht (Urteil des EuGH, Rs. C-557/12 – Kone)
9. Private Kartellrechtsdurchsetzung: Zum Problem der Schadensabwälzung (Art. 12 Abs. 2 RL 2014/104/EU und § 33 GWB)Das Seminar findet als Blockveranstaltung in der zweiten Semesterhälfte statt. Bei ausreichendem Interesse werde ich versuchen, die Veranstaltung in Brüssel abzuhalten und einen Besuch bei den europäischen Institutionen zu ermöglichen.
Bei allen Themen kann - nach verbindlicher Anmeldung - eine Verbuchung als Hausarbeit im Privatrecht (§ 28 Abs. 2 Nr. 2 StudPrO) erfolgen. Es wird auch in diesem Fall ein Seminarvortrag erwartet. Alternativ kann eine Schlüsselqualifikation erworben werden. Wird die Seminarleistung mit „gut“ bewertet, ist durch den zusätzlich ausgestellten Seminarschein die Promotionsvoraussetzung des § 5 Abs. 5 Nr. 1a PromO 2013 erfüllt.
Eine erste Vorbesprechung mit Vorstellung der Themen findet am Montag, 28. Januar 2019, um 16 Uhr c.t. in N7-100 statt. Eine unverbindliche Voranmeldung kann ab sofort im Sekretariat von Prof. Dr. Frank Weiler (Frau Rott, H0-33, H-Gebäude) oder per E-Mail an Friedrich-Wenzel.Bulst@ec.europa.eu erfolgen.
