Gibt es ein Recht zu strafen? Aus welchem Grund oder zu welchem Zweck besteht gegebenenfalls dies Recht? Lässt sich daraus das angemessene Strafmaß bestimmen? Über viele Generationen waren Fragen wie diese, wichtige Gegenstände der rechtsphilosophischen Debatte.
Diskutiert werden vor allem drei Theorien: zwei "relative" Theorien, die den Straftäter zum Mittel der Vorbeugung machen, und zwar entweder der Generalprävention (Abschreckung) oder aber der Spezialprävention (z. B. Wiedereingliederung, Resozialisierung) und die "absolute" Theorie der Vergeltung bzw. Retribution, die den Straftäter als mündigen Täter seiner Tat betrachtet, womit er sich die Strafe selbst zuzieht. Ausgehend von Kant, Fichte, Feuerbach und Benjamin Erhard werden wir die Entwicklung der Theorie bei Bentham, Austin und Hart verfolgen.Für eine Leistungsbescheinigung (im BA- oder Master of Education-Studiengang) wird ein Portfolio erwartet. Es wird in der Veranstaltung bekannt gegeben.
