Im Wintersemester 2026/2027 veranstalte ich ein Seminar zum römischen Erbrecht mit folgenden Themen:

1. Pupillarsubstitution und Mündeltestament
2. Das Intestaterbrecht der Mutter und das der Kinder nach ihrer Mutter: SC Tertullianum und SC Orfitianum
3. Patronatisches Erbrecht: Das Intestaterbrecht nach Freigelassenen
4. Römisches Noterbenrecht: Konkurrenzfragen von querela inofficiosi testamenti und bonorum possessio contra tabulas
5. Die querela inofficiosae donationis als möglicher Schutz vor Umgehung der querela inofficiosi testamenti
6. Lex Falcidia: Streitfragen der falzidischen Rechnung
7. Das Erbschaftsfideikommiss: SC Trebellianum und SC Pegasianum
8. Fideikommiss und heres fiduciarius

Das Seminar richtet sich an fortgeschrittene Studierende und an Studierende, die bereits die Erste Prüfung bestanden haben.

Voraussetzung für die Teilnahme sind gute Kenntnisse im Zivilrecht, wünschenswert sind Kenntnisse im römischen Recht.

Eine Vorbesprechung findet statt am 15.10.2026, 16-18 Uhr in S2-113. Anmeldungen können ausschließlich in dieser erfolgen. Das Seminar findet nicht wöchentlich statt, sondern als Blockveranstaltung im Februar 2027, ergänzt um einzelne wöchentliche Sitzungen.

Es kann ein Seminarschein als Promotionsvoraussetzung erworben werden.
