291015 Aufbau- und Vertiefungskurs im Privatrecht: Kreditsicherungsrecht (V) (SoSe 2008)

Das Kreditsicherungsrecht umfasst Personalsicherheiten (z.B. Bürgschaft) und Realsicherheiten (z.B. Grundpfandrechte). Es bezieht sich somit auf schuld- wie auch auf sachenrechtliche Fragestellungen und sehr examensrelevant.
Erörtert und vertieft werden die wichtigsten Kreditsicherungen, ihre Einsatzmöglichkeiten und Gestaltungsvarianten (z.B. Bürgschaftsvereinbarungen, Eigentumsvorbehaltsformen, Sicherungsübereignungen). Insoweit werden auch vertragsgestalterische Überlegungen angestellt werden müssen.
Aufbau und Probleme werden auch mit Fallbearbeitungen eingeübt.In der Veranstaltung wird eine Klausur (§ 28 Abs. 2 Nr. 1 StuPrO 2007) angeboten.
