Die Vorlesung behandelt die geschichtliche Herausbildung des modernen Strafrechts (Strafrechtsdenken) aus den früheren Formen, in denen Recht und Religion, Recht und Aberglauben, Recht und Volksbrauch noch unmittelbar verbunden waren. Schwerpunkte stellen auch die Strafrechtstheorie der Aufklärung und der Rückfall in das Nationalsozialistische System dar.
Scheinerwerb: Es wird nach § 21 Abs. 2 StudPrO 2003 eine Semesterabschlussklausur gestellt, die zum Erwerb eines "kleinen Grundlagenscheins" führt.
