Das Seminar gibt eine Einführung in die Vertragstheorie der Staats(be-)gründung und vermittelt dabei einen Überblick sowohl über die Klassiker der Vertragstheorie (v.a. Hobbes, Locke und Rousseau) als auch über zeitgenössische vertragstheoretische Ansätze sowie über kritische Perspektivierungen der Vertragstheorie und schließlich auch über ihre Implikationen für die grenzüberschreitende Politik. Im Mittelpunkt des Seminars stehen 1.) die Bedeutung des vertragstheoretischen Denkens für die Konstituierung, Struktur und Funktionslogik moderner Staatlichkeit, 2.) ausgewählte Fortentwicklungen und Kritiken des vertragstheoretischen Denkens sowie 3.) auch die Frage, inwieweit das kontraktualistische Verständnis von (Volks-) Souveränität, Rechtsstaatlichkeit und Demokratie unter transnationalen Bedingungen noch Aktualität beanspruchen kann.
