Für die Dogmatik ist das Recht eine Normenordnung, die mit den "Auslegungsmethoden" aufgearbeitet und als ein System von Sollenssätzen dargestellt wird. Das Recht ist aber auch ein soziales Phänomen, das in den Verhältnissen der Menschen gelebt wird. Es entsteht hier (und wird Gesetz oder Urteil); es wird verwirklicht, angewendet, gebogen oder gebrochen (und wieder hergestellt); es wird weiterentwickelt, gestärkt oder geschwächt (und sogar außer Kraft gesetzt). Die Vorlesung geht auf die vielfältigen Strukturen dieses gesellschaftlichen Rechtslebens ein.
