§ 238 StGB ist eine relativ neue Strafvorschrift. Es handelt sich um einen Straftatbestand, der in seiner Entstehungsgeschichte heftig umstritten war. Das gilt auch nach seinem Inkrafttreten.
Im Seminar geht es zum einen um die ausführliche Betrachtung einer erstaunlichen Gesetzgebungsgeschichte.
Zum anderen werden empirische und kriminologische Grundlagen des
Stalking aufgearbeitet sowie interdisziplinäre Zusammenhänge hergestellt. Die Debatte um Gewaltschutz und Frauenrechte wird dabei ebenso eine Rolle spielen wie die internationale Sicht auf das Phänomen Stalking.Vorbesprechungstermin: 23. April 2012, 16.15 Uhr in U 8 – 207.
