Contents, comment

In Wintersemester 2016-2017, I will organize a seminar (with seven appointments) where we analyze and discuss recent judgments against Germany of the European Court of Human Rights. The following themes will be discussed:
• Article 3 ECHR (prohibition of torture): inhuman detention facilities
• Article 5 ECHR (right to liberty): preventive detention (Sicherungsver-wahrung) / placement in psychiatric hospital / length of pre-trial detention
• Article 6 ECHR (fair trial): the concept ‘hearing’ / the use of unlawfully ob-tained evidence / the right to examine a witness / presumption of inno-cence
• Article 7 ECHR (legality principle): retrospective punishment;
• Article 8 ECHR (right to respect of privacy): suspension of contact with ap-plicant’s own child
• Article 10 ECHR (freedom of expression): criminal liability of anti-abortion campaign / campaign against burgomaster of Dresden (Zweckentfrem-dung)
• Article 14 ECHR (prohibition of discrimination): electoral discrimination

The weekly appointments are on Fridays from 10h30 till 13h00 on the following dates: 4rd, 11th and 18th November 2016, 6th, 20th and 27th January 2017 and 3rd February 2017.

Students can acquire one of the following: (1) a ‘kleiner Grundlagenschein’ (re-quirement: presentation); (2) a ‘großer Grundlagenschein’ (requirements: presen-tation and essay) or; (3) a ‘Fremdsprachennachweis’ (requirement: presentation).
