In der familien- und erbrechtlichen Praxis verlassen sich die Beteiligten häufig nicht allein auf das Modell des Gesetzgebers (z.B. gesetzlicher Güterstand, gesetzliche Scheidungsfolgen; gesetzliche Erbfolge). So kommt schon vor Eingehung einer Ehe der Abschluss eines Ehevertrags in Betracht, um der konkreten Situation und Arbeitsteilung der Eheleute Rechnung zu tragen. Schon hierbei, jedenfalls aber im Zeitpunkt der Trennung der Eheleute werden sehr häufig die gesetzlichen Folgen der Ehe im Familien- und Erbrecht modifiziert. Diese Problematik die beschäftigt die Rechtsprechung bis hin zum BverfG und dementsprechend auch Rechtsanwälte und Notare.
Die Veranstaltung möchte unter der Zukunftsperspektive der Gestaltung das Familien- und Erbrecht erschließen, um methodische Grundlagen, Grenzen und Instrumente der privaten Rechtssetzung aufzuzeigen. Dies soll anhand zahlreicher Beispiele und Muster aus der Praxis geschehen.
