Im Zentrum des Seminars stehen die normativen Grundlagen und die praktischen Durchsetzungsmechanismen des im Rahmen der Vereinten Nationen entstandenen Menschenrechtssystems. Die Wirkungsweise der Menschenrechtsmechanismen soll am Beispiel des Einsatzes zur Überwindung der Folter näher illustriert werden.

  • Zur Geschichte und Ideengeschichte der Menschenrechte - ein Überblick
  • Die Allgemeine Erklärung der Menschenrechte von 1948. Historische Bedeutung und normativer Gehalt
  • Der universale Geltungsanspruch der Menschenrechte in der Diskussion
  • Zur "Unteilbarkeit" der Menschenrechte
  • Die zentralen Menschenrechtskonventionen der Vereinten Nationen - ein Überblick
  • Berichtspflichten, Staatenbeschwerde und Individualbeschwerde: Chancen und Grenzen der Durchsetzung internationaler Menschenrechtskonventionen
  • Das absolute Folterverbot: Vorgaben der Menschenrechtskonventionen (einschließlich der "General Comments" der Vertragsausschüsse)
  • Zur Funktionsweise der Anti-Folter-Konvention der Vereinten Nationen
  • Das Zusatzprotokoll zur Anti-Folter-Konvention - ein präventiver Ansatz im Kampf gegen die Folter

Von den Teilnehmerinnen und Teilnehmern wird erwartet, dass sie einige Grundlagentexte vorweg lesen, um an der Diskussion aktiv mitwirken zu können. Interessierte Studierende werden gebeten, sich bei mir zum Seminar anzumelden (bielefeldt@institut-fuer-menschenrechte.de).
