Rechtsdurchsetzung im Privatrecht
Rechte dürfen grundsätzlich nicht im Wege der Selbsthilfe durchgesetzt werden. Der Staat mit seinem Gewaltmonopol hat die Durchsetzung zu gewährleisten. Erst nach Feststellung eines Anspruchs im Erkenntnisverfahren (Zivilprozess) kann die Zwangsvollstreckung nach dem 8. Buch der ZPO und nach dem ZVG beginnen. Mit Voraussetzungen und Arten der Einzelzwangsvollsteckung wird sich die Veranstaltung zunächst beschäftigen, um sich dann der Gesamtvollstreckung (Insolvenz) zuzuwenden. Während die Einzelzwangsvollstreckung der Befriedigung einzelner Gläubiger dient, ist das Insolvenzverfahren von der gemeinschaftlichen und gleichmäßigen Befriedigung der persönlichen Gläubiger geprägt (§ 1 InsO).
Insgesamt ist in der Veranstaltung nicht nur die systematische Erfassung des Stoffes beabsichtigt, sondern auch die Einbeziehung zahlreicher Fälle und Muster aus der Praxis.Literatur wird in der Veranstaltung bekannt gegeben.
