Schwerpunktveranstaltung für SPB 7 - Arbeit und sozialer Schutz (StudPrO 2007)
Das Betriebsverfassungsrecht ist Teil des kollektiven Arbeitsrechts. Es behandelt die betriebliche Mitbestimmung der Arbeitnehmer. Die Vorlesung behandelt die Grundbegriffe, die Wahl und Zusammensetzung des Betriebsrats, die Rechtsstellung seiner Mitglieder, die Regelungsinstrumente und vor allem die Beteiligung des Betriebsrats bei betrieblichen Regelungsfragen. Ein Schwerpunkt wird die erzwingbare Mitbestimmung in sozialen Angelegenheiten nach § 87 BetrVG und die Mitbestimmung in personellen Angelegenheiten (§§ 99 ff. BetrVG) sein. Schließlich beinhaltet die Vorlesung noch die Themen Betriebsänderung, Interessenausgleich, Sozialplan und Nachteilsausgleich.
