Die Veranstaltung richtet sich an Studierende ab dem 3. Semester. Der Schwerpunkt wird angesichts der wenigen SWS klar im Mobiliarsachenrecht liegen müssen. Für den Erwerb der vollständigen für das Staatsexamen notwendigen Kenntnisse im Sachenrecht wird darüber hinaus dringend in einem späteren Semester der Besuch des AVK Sachenrecht und/oder des AVK Kreditsicherungsrecht sowie ggf. der VL Liegenschaftsrecht (SPB 1) empfohlen.
Begonnen wird – nach einer allgemeinen Einführung, insbesondere in die Grundsätze des Sachenrechts – mit dem Besitz und dem Besitzschutz. Ausführlich wird der rechtsgeschäftliche und gesetzliche Eigentumserwerb an beweglichen Sachen behandelt. Danach folgen der Eigentumsschutz durch Herausgabeklage und das Eigentümer-Besitzer-Verhältnis (EBV) sowie Unterlassungs- und Beseitigungsansprüche. In das Liegenschaftsrecht (Immobiliarsachenrecht) einschließlich Nachbarrecht und Grundpfandrechte wird eine Einführung gegeben.Zum Leistungsnachweis (Modul Privatrecht B) wird eine Klausur mit 120 Min. Bearbeitungszeit angeboten.
