Neben förmlichen Gesetzen - dem so genannten "hard law" - spielen bei der gesellschaftlichen Regulierung Aspekte des "soft law" eine wichtige Rolle. Darunter versteht man nichtstaatliche, von unterschiedlichen Gremien erlassene Normen und Standards, etwa technische Regeln, Richtlinien oder DIN-ISO-Normen, Corporate Codes of Conduct oder verschiedene Formen der Selbstbindung, etwa in der Wirtschaft oder der Wissenschaft. Sie unterscheiden sich vom staatlichen Recht hinsichtlich ihrer Geltungsstruktur/Verbindlichkeit, der normsetzenden Institutionen und der Formen der (Selbst-) Regulierung.
Das Seminar beschäftigt sich zunächst auf theoretischer Ebene mit den Begriffen der Norm und der Regulierung.
Danach werden in Arbeitsgruppen Recherchen zu einzelnen Fallbeispielen der nichtstaatlichen (Selbst-) Regulierung durchgeführt und im Plenum präsentiert. Dazu können etwa Corporate Codes of Conduct, DIN-ISO-Normierungen (Corporate Social Responsibility), die europäische Chemikalienregulierung REACH, aber auch Gremien wie Ethikräte und wissenschaftliche Selbstregulierungsgremien und deren Normierungsaktivitäten zählen.
Die Veranstaltung wird online abgehalten. Zutritt zu den zoom-Sitzungen im Ordner "Meetings" erhalten Sie mit dem Zugangscode, der angemeldeten Teilnehmerinnen und Teilnehmern vor Semesterbeginn per Email mitgeteilt wird.
