Seminar zur Vertragsgestaltung (Jost)
Die Arbeit des Rechtsanwalts und des Notars besteht zum großen Teil nicht in der Erwirkung richterlicher Entscheidungen, sondern in der Gestaltung von Rechtsverhältnis-sen. Die Methodik hierfür soll in der Veranstaltung anhand zahlreicher Beispielsfälle aus zentralen Bereichen des bürgerlichen Rechts vermittelt werden. Das Seminar, in welchem der Grundlagen- und der Wahlfachschein erworben werden können, wird weitgehend den Charakter eines Kolloquiums tragen. Es werden Referate ausgegeben; in den einzelnen Sitzungen sollen diese aber nicht lediglich vorgetragen, sondern Gestaltungsmöglichkeiten gemeinsam an Beispielsfällen erarbeitet und zwischen "Vertragsparteien" ausgehandelt werden.
Ein ausführliches Literaturverzeichnis wird in der Vorbereitungssitzung bzw. in der ersten Sitzung im Sommersemester 2001 ausgegeben werden.
