291213 Fehlurteile im Strafverfahren (V) (SoSe 2024)

Was sind die Ursachen für Fehlurteile? Lassen sie sich verhindern? Kann man Justizirrtümer korrigieren? Das sind die zentralen Fragen für die Vorlesung, auf die nach Antworten aus ganz unterschiedlichen Fachgebieten gesucht wird. Es geht erstens um typische Fehlerquellen im Strafverfahren (also um die kriminalistischen Ursachen von Justizirrtümern), zweitens um Möglichkeiten, diese Fehlerquellen im tatgerichtlichen Verfahren auszuschalten (also um die Prävention von Fehlurteilen durch entsprechende Ermittlungen bzw. effektive Verteidigung) sowie drittens um das Wiederaufnahmeverfahren gem. §§ 359 ff. StPO (also um etwaige strafprozessuale Korrekturmöglichkeiten). Für besonders Interessierte besteht im nachfolgenden Semester Gelegenheit, an konkreten Wiederaufnahmeverfahren mitzuwirken.
Eine Klausur (SPB 8 Bereich 3) sowie Hausarbeiten werden angeboten.
