Das Verhältnis von Verbrechen und Legalität wird im rechtspositivistischen Verständnis als asymmetrisch charakterisiert. Im Gegensatz dazu präsentiert Hans Magnus Enzensberger in seiner erstmals 1964 publizierten Schrift `Politik und Verbrechen` eine gänzlich andere Perspektive. Habermas schreibt dazu: „Unter dem Titel Politik und Verbrechen präsentiert Enzensberger seine eigenen Versuche, die Auffassungen von Recht und Rechtsverletzung, von Staat, Herrschaft, Gehorsam und Verrat zu revidieren. Es sind Versuche, das Verbrecherische an der Politik selber zu entlarven.“ Das Seminar geht der Frage einer Symmetrie von Politik und Verbrechen anhand von älteren und neueren (z.B. Das Versagen der UNO in Ruanda, Guantanamo, soziale Ungleichheit) Fallstudien nach.
