Seit bald 20 Jahren gilt das UN-Kaufrecht (CISG) praktisch für alle Exportgeschäfte deutscher Unternehmen und für Importe aus derzeit 71 Vertragsstaaten. Über 80% des deutschen Außenhandels werden mit Geschäftspartnern aus anderen Vertragsstaaten des UN-Kaufrechts abgewickelt. Das BGB/HGB hat für internationale Handelsgeschäfte kaum noch Bedeutung. Zudem stand das UN-Kaufrecht „Pate“ für Teile der Schuldrechtsreform und hat zudem den Draft Common Frame of Reference (Europäisches Vertragsrecht) inspiriert.
Die Veranstaltung stellt die Strukturen und Inhalte des UN-Kaufrechts umfassend dar, vergleicht mit den Parallelregelungen des BGB/HGB, zeigt die Verbindungen zum Internationalen Privatrecht auf und unterbreitet Anregungen zur Vertragsgestaltung.Literaturangaben:
