? Die Studierenden können die Hintergründe und Strafbarkeitsvoraussetzungen der Tötung auf Verlangen skizzieren.? Sie sind in der Lage, die Voraussetzungen der Tötung auf Verlangen von der Beihilfe zum Suizid abzugrenzen und die jeweiligen straf- und berufsrechtlichen Folgen zu benennen.
? Sie können die Grundzüge des allgemeinen Persönlichkeitsrechts und insb. des Rechts auf selbstbestimmtes Sterben erläutern.
? Sie sind in der Lage, die wesentlichen Erwägungen des Bundesverfassungsgerichts, das Verbot der geschäftsmäßigen Förderung der Selbsttötung für verfassungswidrig zu erklären, wiederzugeben.
? Darstellung der strafbaren Handlung, einen Menschen aufgrund dessen ausdrücklichen und ernsthaften Verlangens zu töten (\"aktive Sterbehilfe\").? Abgrenzung der Tötung auf Verlangen zur (strafrechtlich) straflosen Beihilfe zum Suizid.
? Schutzbereich des Rechts auf selbstbestimmtes Sterben als Ausdruck des allgemeinen Persönlichkeitsrechts (Art. 2 Abs. 1 i.V.m. Art. 1 Abs. 1 GG).
? Verfassungswidrigkeit der geschäftsmäßigen Förderung der Selbsttötung (? 217 StGB a.F.) - Entscheidung des Bundesverfassungsgerichts v. 26.02.2020.
