Was ist Recht? und Was ist Unrecht? – Diese beiden Fragen lassen sich nicht mit einfachen Erklärungen beantworten, sind sie doch komplex und stellen sich als grundlegende Fragen auch des heutigen rechtswissenschaftlichen Studiums dar. Insofern geht es um die Aufarbeitung historischer Bemühungen, diese Fragen zu beantworten. Im Rahmen dieser Bemühungen gelangt man zu weiterführenden Problemen: Was versteht man unter rechtsstaatlicher Politik? In welchem Verhältnis stehen Rechtsphilosophie und Rechtspolitik? Die unterschiedlichen Konzeptionen von Recht und Staat werden systematisch geordnet und immer wieder anhand aktueller Fragen und Problembereiche vorgestellt. Zu Beginn der Veranstaltung wird ein Vorlesungsskript verteilt. Begleitmaterial zur Vorlesung erfolgt über Jurmoodle. Am Ende des Semesters werden eine Klausur (kleiner Grundlagenschein oder als Leistungsnachweis für andere Studiengänge) sowie eine Hausarbeit (großer Grundlagenschein) angeboten. Einführende Literatur: Naucke / Harzer, Rechtsphilosophische Grundbegriffe, 5. Aufl., 2005; Seelmann, Rechtsphilosophie, 5. Aufl., 2010.
