Im Sommersemester 2018 veranstalte ich ein Seminar im römischen und bürgerlichen Recht mit folgenden möglichen Themen:
1. Maior pars – Mehrheitsdenken im römischen Recht (Ernst, SZ 132, 2015, 1ff.)
2. Die Gefahrtragung bei Miet-, Pacht-, Dienst- und Werkvertrag (locatio conductio) im klassischen römischen Recht
3. Aeque perituris. Kausalitätsfragen im römischen Recht
4. Die romanistische Lehre vom bedingten Rechtsakt
5. Der Schutz des Schwächeren im römischen Privatrecht
6. Rechtsfragen der Bitcoins
7. Rechtsfolgen der aliud-Lieferung beim Kauf
8. Die Regelung des Gattungskaufs im BGB
9. Abschied vom Vorrang der Leistungsbeziehung? (Thomale/Zimmermann, AcP 217, 2017, 246 ff.)
10. Neues zum Rückerwerb des Nichtberechtigten? (Hoffmann, AcP 115, 2015, 794 ff.)
Eine Vorbesprechung findet statt am Donnerstag, 12.04.2018, 14 – 16 Uhr in Raum H1-116. Die verbindliche Übernahme eines Themas erfolgt ab sofort persönlich bei dem Unterzeichneten (Terminvereinbarung mit dem Lehrstuhlsekretariat erbeten), spätestens jedoch in der Vorbesprechung. Für die Übernahme der Themen 1-5 ist in der Regel Voraussetzung der vorangegangene Besuch der Vorlesung Römisches Recht. Die Teilnahme an der Vorbesprechung ist für alle Seminarteilnehmer verbindlich. Das Seminar findet voraussichtlich als Blockseminar am 6./7.7. 2018 statt.
Es kann ein Seminarschein und zusätzlich nach Absprache entweder der große Grundlagen-schein (§§ 28 Abs. 2 Nr. 3, 20 Abs. 1 Nr. 4 StudPrO 2012) oder die Bescheinigung über die große Hausarbeit im Privatrecht (§ 28 Abs. 2 Nr. 2 StudPrO 2012) erworben werden.
