In Wintersemester 2016-2017, I will organize a seminar where we analyze and discuss recent judgments against Germany of the European Court of Human Rights. The following themes will be discussed:
• Article 3 ECHR (prohibition of torture): detention conditions;
• Article 5 ECHR (right to liberty): preventive detention (Sicherungsver-wahrung) / placement in psychiatric hospital;
• Article 6 ECHR (fair trial): the concept ‘hearing’ / the use of unlawfully ob-tained evidence / the right to examine a witness / presumption of inno-cence;
• Article 7 ECHR (legality principle): retrospective punishment.
Students will work in duo’s analyzing a case and hold a presentation about it. Af-terwards each student has to write a case-note (max. 10 pages) individually. If a case-note is noted with 13 points or higher, the student has the option to work to-gether with me on publishing the case-note.
The meetings are planned for 2nd and 16th December 2016, 13th January 2017 and 10th February 2017 in U8-138, starting at 10h00. The end time will depend largely on the number of students(' presentations), but latest 14h00.
The preliminary meeting and topic allocation (through lottery) will take place at Friday 18th November 2017 at 14h00-16h00 in U8-138 .
