291050 Seminar: Principles of the Existing EC Private Law (S) (SoSe 2007)

EC law, in particular directives and regulations, have been enacted one by one over decades. This piecemeal approach has led to incoherencies both with regard to terminology and substance of EC legislation. Such incoherencies increasingly cause problems for the interpretation of EC law and - even more - for its transposition and incorporation into the laws of the Member States. The European Commission now tackles this problem with its programme for "Better Lawmaking". Scholars try to distil "Principles" from the bits and pieces of EC legislation in order to identify the underlying values and to elaborate guidelines for further legislative development.
The participants of the seminar will compare such initiatives for legislative coherency and assess their prospect of success. They will also be introduced into the first volume of the "Principles of the Existing EC Private Law" drafted by the Acquis Group (www.acquis-group.org).
The block seminar, which will be held in English, will take place 10-12 May 2007 and will partially be held in the form of co-teaching together with Christoph Busch, Maître en Droit. The seminar addresses advanced students with a good knowledge in the field of EC secondary legislation. In particular, it can be attended as an upgrade to the course on European Private Law taught by Prof. Schulte-Nölke and Dr. Twigg Flesner (course N° 291022) for those students who want to write a thesis on the subject.

Active participation requires the preparation of a paper that will be presented during the seminar. For those participants who also want to attend the block course held by Dr. Twigg-Flesner on 11-12 May 2007 (see course N° 291022) it will be possible to present their paper on 10 May 2007. Please register at the secretariat of Prof. Dr. Schulte-Nölke (due to the experiences made in the last term, registrations filed only via the electronic university calendar "eKVV" will not be accepted).

Nichtobligatorische Zusatzveranstaltung im SPB 3 - Internationaler Handelsverkehr/International Trade (Teilnahme freigestellt; keine Veranstaltung i.S.v. § 33 Abs. 1 oder Abs. 2 StudO). Es besteht die Möglichkeit, im Anschluss an die Veranstaltung eine häusliche Arbeit nach § 43 Abs. 3 StudO anzufertigen. Voraussetzung ist eine Anmeldung nach § 44 Abs. 1 StudO beim Prüfungsausschuss. Es besteht ferner die Möglichkeit zum Erwerb eines Seminarscheins nach § 14 Abs. 1 StudO und/oder - nur für Studierende im Hauptstudium - eines Schlüsselqualifikationsscheins nach § 28 Abs. 3 StudO.
