Die Vorlesung behandelt das Familien- und Erbrecht in dem Umfang, in dem es nach § 11 Abs. 2 Nr. 1 lit. e) und f) JAG NW Pflichtfachstoff der staatlichen Prüfung ist. Im Familienrecht, das in der ersten Semesterhälfte besprochen wird, sind dies die Wirkungen der Ehe im Allgemeinen (§§ 1353-1362 BGB), das gesetzliche Güterrecht (sog. Zugewinngemeinschaft, §§ 1363-1390 BGB), die Verwandtschaft (nur die allgemeinen Vorschriften, d.h. §§ 1589, 1590 BGB) sowie die elterliche Sorge (1626-1698b BGB). Im Erbrecht, das in der zweiten Semesterhälfte Vorlesungsgegenstand ist, besteht der zu besprechende Pflichtfachstoff aus der Erbfolge (§§ 1922-1941 BGB), die Annahme und Ausschlagung der Erbschaft (§§ 1942-1966 BGB), dem Rechtsverhältnis der Erben untereinander (§§ 2032-2057a BGB), dem Testament (§§ 2064-2272 BGB) und dem Erbvertrag (§§ 2274-2302 BGB).
Es wird eine Semesterabschlussklausur angeboten.
Die Materialien zur Veranstaltung werden in Jurmoodle zur Verfügung gestellt. Das Passwort wird in der Vorlesung bekanntgegeben. Eine Vorlesungs- und Literaturübersicht ist auch über die Dokumentablage des eKKV abrufbar.
