Die Vorlesung behandelt das seit 1998 geltende neue Insolvenzrecht.
Dargestellt wird der Ablauf eines Insolvenzverfahrens von der Eröffnung bis zur Beendigung. Dabei sollen vor allem auch aktuelle Fälle aus der Tagespresse berücksichtigt werden.
Eingegangen wird weiterhin auf besondere Verfahrensgestaltungen wie die Eigenverwaltung ( Kirch-Media ), das neue Verbraucherinsolvenz- und Restschuldbefreiungsverfahren und die Neuerungen im Internationalen Insolvenzrecht.
Die Vorlesung richtet sich an Hörer, die bereits die Vorlesungen im Zivilprozeßrecht und Zwangsvollstreckungsrecht besucht haben. Speziell das Insolvenzrecht wirft nicht nur prozessuale, sondern darüber hinaus zahlreiche kreditwirtschaftliche, arbeitsrechtliche und gesellschaftsrechtliche Fragen auf. Ziel der Veranstaltung ist daher u.a. auch, über den konkreten Vorlesungsstoff hinaus das Ineinandergreifen der einzelnen Rechtsgebiete in der Praxis aufzuzeigen.
